A LOCAL media firm has filed an application, seeking orders to commit to jail Clouds Media Group top officials and Nigerian musician Adedeji Adeleke, alias Davido, for contempt of court.

Times Radio FM and Times Promotions and Entertainment Limited, through their advocate Peter Kibatala, filed the application at the Kisutu Resident Magistrate’s Court in Dar es Salaam on Monday under a certificate of urgency.

Other respondents in the matter are Clouds Media Group Chief Executive Officer, Prime Time Promotions CEO and HKN Music Limited Managing Director.

“This court be pleased to order that the Chief Executive Officers of the 1st and 2nd respondents, Clouds Media Group and Prime Time Promotions, as well as the 4th respondent, Adedeji Adeleke alias Davido, be committed as Civil Prisoners for the statutory period of six months,” reads part of the prayer.

It is alleged that the four have deliberately and calculatedly disobeyed injunctive orders issued by the court, restraining the Nigerian star from performing at Serengeti Fiesta 2014 grand finale held at Leaders Club grounds in Dar es Salaam on October 18.

The restrain order was to remain in force pending the hearing and final determination of the main suit. In the alternative, the two applicants are requesting for an order that the properties of Clouds Media Group and Prime Time Promotions CEOs be attached.

The properties include office furniture and company vehicles worth 45,000 UD dollars, being the value of the contract between Times Radio FM, HKN Music Limited Managing Director and the Nigerian Musician.

The applicants also seek attachment of Davido’s personal properties. In an affidavit to support the application, a senior official with the applicants, Rehure Richard Nyaulawa, stated that they filed in court a case against the respondents on October 17, this year, claiming for various reliefs.

Simultaneous with the filing of the suit, they also applied for an injunction which the court issued on the same day against the respondents.

Despite the order in question, the respondents hosted and facilitated Davido’s performance at the Serengeti Fiesta 2014 final at the Leader’s Club last Saturday.

Such acts not only derogate the court order which was issued to protect the contractual interests of the applicants but also tend to defeat the dignity of the court because by coming to court the applicants had intended all court orders issued pursuant to their prayers be fully abided by.
